Definitions

• Bing: The online platform providing restaurant and café management services.

• Restaurant/Café: The business entity registered on the platform.

• Services: Including bookings management, branches, reviews, analytics, advertising, promotions, and paid packages.

  
  

Account Registration

• Accurate and complete information must be provided.

• Restaurants are responsible for maintaining account security.

• Bing reserves the right to suspend or terminate accounts for misuse or false information.

Bookings & Branch Management

• Bing provides tools to manage bookings and branches.

• Restaurants are responsible for keeping availability and operating hours up to date.

The Second Party (the Restaurant or Café) hereby expressly, irrevocably, and unconditionally acknowledges and agrees as follows:

1. Role of the Platform
   Bing operates solely as a technology intermediary platform, providing technical tools for displaying and managing bookings and branches only. Bing shall not, under any circumstances, be considered a party to any agreement or contractual relationship between the Restaurant/Café and its customers.

   
   

2. Direct Relationship Between Parties
   All bookings made through the Platform constitute a direct and independent arrangement between the Restaurant/Café and the customer. No legal, contractual, or financial obligation shall arise against Bing in relation to such bookings.

   
   

3. Complete Disclaimer of Liability
   The Restaurant/Café hereby fully and finally releases, discharges, and holds harmless Bing from any and all liabilities, claims, demands, losses, damages, or causes of action, whether direct or indirect, present or future, arising out of or related to:

   • Failure to honor or execute any booking

   • Cancellation, modification, or delay of bookings

   • Customer no-shows

   • Failure of the Restaurant/Café to fulfill a booking

   • Any operational or administrative issues related to bookings or branch management

For any reason whatsoever, without limitation.

4. No Guarantees
   Bing does not guarantee the accuracy, completeness, or validity of booking data entered by the Restaurant/Café or customers, nor does it guarantee customer attendance or the Restaurant/Café’s fulfillment of any booking.

   
   

5. No Responsibility for Disputes
   Bing shall bear no responsibility or liability for any disputes, compensation claims, losses, damages, or legal actions arising between the Restaurant/Café and customers in connection with bookings or branch management.

   
   

6. Indemnification
   The Restaurant/Café agrees to fully indemnify, defend, and hold harmless Bing, its owners, directors, employees, and affiliates from and against any and all claims, damages, liabilities, costs, or expenses (including legal fees) arising from or related to bookings, branch management, or any claims brought by customers or third parties.

   
   

7. Survival Clause
   This clause shall remain valid, binding, and enforceable notwithstanding the termination or expiration of the agreement between the parties for any reason.

   
   

Reviews & Content

• Reviews reflect customer opinions only.

• Bing may remove content that violates policies or is abusive.

• Restaurants may not manipulate or unfairly influence reviews.

  
  

Bing offers paid services for restaurants and cafés, including:

• Packages: Monthly or yearly subscriptions to enhance visibility.

• Advertising: Ability to run featured ads within the app or website.

• Promotions: Payment for posting special offers to users.

  
  

All payments are processed through secure and authorized payment providers to ensure the safety of restaurant and customer data:

• The website does not store credit card information.

• All transactions are encrypted and secure.

• Subscriptions, ads, and promotions are subject to the payment provider’s terms.

• Restaurants and cafés can manage or cancel packages, ads, or promotions anytime via their account.

  
  

Refund Policy 

This Refund Policy explains the terms and conditions for refunds related to paid services offered by Bing to restaurants and cafés, including packages, advertisements, and promotions.

Packages & Subscriptions

• Subscription fees are non-refundable once activated or used.

• If a technical issue caused by Bing prevents proper use of the service, a refund or compensation may be considered on a case-by-case basis.

• Upon cancellation, the subscription remains active until the end of the paid period with no automatic renewal.

  
  

Advertisements

• Advertising fees are non-refundable once the campaign has started.

• If an ad does not run due to a technical issue caused by Bing, the restaurant is entitled to a refund or an equivalent ad extension.

Promotions

• Promotion fees are non-refundable once published or activated.

• If a promotion fails to appear due to a technical issue, Bing may provide compensation or a refund depending on the situation.

Refund Method

• Approved refunds will be issued using the original payment method.

• Refund processing may take 7–14 business days depending on the payment provider.

• Restaurants are responsible for the accuracy of advertising content.

6️- Packages, Subscriptions & Payments

• Bing offers monthly and yearly subscription packages.

• All payments are processed via secure, authorized payment providers.

• Bing does not store credit card details.

• Subscriptions are subject to the Refund Policy, which is non-refundable once activated.

  
  

7️- Refund Policy

• All payments are governed by the Refund Policy published on the website and form part of these Terms.
